Appendix K Update

Why does that matter?

Because as of January 1, 2024, providers will not be able to deliver Shared Living and HPC on the same day. We encourage you to start meeting with people impacted by this service change NOW to prepare for the transition.

Appendix K allows states to make changes to respond to emergencies like Covid 19. With the official end of the Public Health Emergency on 5/11/23, flexibilities allowed under Appendix K expired on 11/11/23. However, due to Centers for Medicare and Medicaid Services (CMS) guidance, Ohio flexibilities will remain in effect until 12/31/23.

Beginning January 1, 2024, boards will need to authorize shared living and residential respite in 15-minute units pursuant to the Ohio Administrative Code 5123- 9-34.
